On February 3, PIJIP Faculty Director Christine Haight Farley will present on the Trademark Modernization Act at the Advanced Trademark Seminar, a webinar sponsored by Kilpatrick Townsend.

The Trademark Modernization Act was enacted in December 2020 and became effective in December 2021. The major impact of this legislation was to codify the presumption of irreparable harm in trademark infringement cases (in contrast with copyright and patent cases) and to create two new mechanisms to deal with clutter in the trademark register and the recent rise in fraudulent trademark registrations. While the law was under debate, Prof. Farley was invited by the House Judiciary Committee’s Subcommittee on Courts, Intellectual Property, and the Internet to participate in two separate roundtables on the draft legislation.
